Abstract
The emerging jus ante bellum strand of the just war tradition asks how States preparing for the possibility of war can do so ethically. Many States considering developing and fielding weapons enabled by artificial intelligence (AI) to protect themselves in case of war. Setting to one side calls for prohibition of or restrictions on such weapons, this chapter argues that jus ante bellum requires that States that continue to engage in this process must meet two obligations. First, they must conduct a rigorous test, evaluation, verification, and validation (TEV&V) and legal review process to ensure that AI-enabled weapons are safe, reliable, and can be used lawfully before they are fielded and made available for use. This will require revising the current TEV&V process for conventional weapons to account for the distinctive characteristics of those enabled by AI. Second, they must develop these weapons so as not to trigger a sense of insecurity on the part of other States that leads them to field such weapons without rigorous TEV&V and legal review. The chapter maintains that the potential risks of AI-enabled weapons make the jus ante bellum an especially useful framework for guiding State development and fielding of these weapons.
