Abstract
This chapter calls for a reframing of the concept of women in international law through the lens of global critical race feminism (GCRF). It is a concern with the rights of women of color, whether they be located in the Global North or Global South. Many scholars have critiqued both national and international evolutions of feminism as omitting the plight of such women, who are disproportionately stalled at the bottom of each society—economically, socially, and politically. Even in this volume, there is an underrepresentation of coverage on Asia and the Middle East. GCRF contributes to the development of international law, global feminism, and postcolonial theory by demarginalizing women of color in a theoretical and practical sense. Women of color may be simultaneously dominated within the context of imperialism, neocolonialism, or occupation as well as national patriarchy, culture, and customs. The multiple forms of discrimination they face simultaneously can be based on identities such as nationality, race, color, ethnicity, gender, class, sexual orientation, disability, religion, age, language, and ideology. The chapter uses concepts that have evolved from GCRF and adds to the literature by calling for them to be applied comprehensively to all women, not just women of color, thus moving from the margins to the center of analyses of women and international law.
