Abstract
The article analyzes the use of non-consensual brain scans to show the memory of an event under the civil liberties guarantees of international law in the U.S. It provides overview of the brain scan technology and its potential use in criminal prosecutions in the court. It also draws conclusions as to the legality of brain scan evidence under the human rights norms.
